2. Information and consent

The Personal Data Protection Law (hereinafter “LPDP”) and the General Data Protection Regulation (Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, hereinafter “GDPR”) ensure the protection of individuals with regard to the processing of personal data and the free movement of such data.

Under the legal terms, “personal data” is considered to be any information, of any nature and regardless of its format, including sound and image, relating to an identified or identifiable natural person, and therefore the protection does not cover data of legal entities.

By accepting this Privacy Policy, the user provides their informed, express, free, and unequivocal consent for the personal data provided through the website https://www.projecthab.pt/ to be included in a file under the responsibility of Projecthab, whose processing, in accordance with the LPDP and the GDPR, complies with the appropriate technical and organizational security measures.

Projecthab maintains a database with the registration of its customers. The data present in this database are solely the data provided by the individuals themselves at the time of their registration, being collected and processed automatically, in accordance with the terms approved by the National Data Protection Commission, by Projecthab, the entity responsible for the corresponding file.

Under no circumstances will information on philosophical or political convictions, party or trade union affiliation, religious beliefs, private life, and racial or ethnic origin, as well as data relating to health and sexual life, including genetic data, be requested.

Under no circumstances will any of the following activities be carried out with the personal data provided to us through this website:

  • Transfer to other individuals or entities, without the prior consent of the data subject;
  • Transfer outside the European Economic Area (EEA), without the prior consent of the data subject.

3. Purposes of personal data processing

The personal data we process through this page will only be used for the following purposes:

  • (i) Execution and management of purchase and sale contracts or service provision;
  • (ii) Order processing;
  • (iii) Communication with customers and clarification of doubts;
  • (iv) Processing of information requests;
  • (v) Processing of complaints, Regulator processes, Pre-litigation processes, or exercise of rights in judicial proceedings;

Projecthab guarantees the confidentiality of all data provided by its customers. However, despite Projecthab collecting and processing data securely to prevent its loss or manipulation, using the most advanced techniques for this purpose, we inform you that collection on an open network allows the circulation of personal data without security conditions, risking being seen and used by unauthorized third parties.

On the other hand, the user consents to access information regarding the service contracted with Projecthab in order to offer additional services to the contracted service.

At the time of data collection, unless otherwise indicated in the fields, the user may voluntarily provide personal data, without the lack of response implying a decrease in the quality or quantity of the corresponding services (unless otherwise indicated). However, failure to respond to mandatory data will result in the inability to access the service for which the data was requested.

If you do not agree with the above conditions, Projecthab will not be able to contract with the user through its website.

4. Transfer of personal data

In order to fulfill the purpose of this website, Projecthab will transfer your personal data to other entities, which will process them for the following purposes:

  • Management and processing of payments activities;
  • Provision of contracted services;
  • Management and participation in events, contests, and campaigns.

The entities to whom Projecthab will transfer your personal data for processing, as mentioned above, will have the following nature:

  • Insurance companies;
  • Third-party entities related to the provision of contracted services;
  • Payment management and processing entities.

5. Security measures

Projecthab declares that it has implemented and will continue to implement the necessary technical and organizational security measures to ensure the security of personal data provided to it, in order to prevent its alteration, loss, processing, and/or unauthorized access, taking into account the current state of technology, the nature of the stored data, and the risks to which they are exposed.

Projecthab guarantees the confidentiality of all data provided by its customers, both in registration and in the process of purchasing/ordering products or services. The collection and processing of data are carried out securely to prevent their loss or manipulation. All data will be entered into a Secure Server (128-bit SSL) that encrypts/encodes them (transforms them into a code). Users can verify that their browser is secure if the padlock symbol appears or if the address starts with https instead of http.

Personal data are processed with the level of protection legally required to ensure their security and to prevent their alteration, loss, processing, or unauthorized access, taking into account the state of technology, and the user is aware and accepts that security measures on the Internet are not impregnable.

Projecthab, whenever it accesses any personal data, undertakes to:

  • Store them through legally required security measures of a technical and organizational nature, ensuring their security and preventing their alteration, loss, processing, or unauthorized access, in accordance with the state of technology at each moment, the nature of the data, and the possible risks to which they may be exposed;
  • Use the data exclusively for the purposes previously defined;
  • Ensure that the data is processed only by workers whose intervention is necessary for the provision of the service, and they are obliged to maintain confidentiality. If there is a possibility that the information may be disclosed to third parties, they must be required to maintain the appropriate confidentiality in accordance with what is stipulated in this document.

6. Commercial and promotional communications

One of the purposes for which we process personal data provided by users is to send electronic communications with information related to commercial and promotional communications.

Whenever we make such a communication, it will be directed exclusively to users who have previously and expressly authorized them.

In accordance with Decree-Law No. 7/2004, of January 7, if the user wishes to stop receiving commercial or promotional communications from Projecthab, they may request to opt-out of the service by sending an email to the following web form: www.projecthab.pt/contactos

7. Exercise of rights

In accordance with the provisions of the LPDP and the RGPD, the user may exercise their rights of access, rectification, erasure, restriction, objection, and portability at any time by requesting through any of the following means:

8. Supervisory authority

Projecthab is registered with the National Data Protection Commission and is a member of ACEPI – Portuguese Association of Electronic Commerce.

Under the law, the data subject has the right to lodge a complaint regarding the protection of personal data with the competent supervisory authority, the National Data Protection Commission (CNPD).
